Legal Policy and Core Advantages of Surrogacy Services in Kyrgyzstan

Open Legal Framework and Clear Policy Support

Kyrgyzstan is one of the few countries that explicitly allows commercial surrogacy, and its legal basis is mainly based on the Law on the Protection of Citizen’s Health, which was amended in 2024. According to the terms of the law:

Legality: The surrogacy contract needs to be notarized, specifying the rights and obligations of the commissioning party and the surrogate mother, and the surrogate mother needs to be between the ages of 20-35 years old, have at least one healthy child, and pass medical genetic counseling.
Applicable groups: Married couples, single women and LGBTQ+ groups can legally apply for surrogacy services, and the law does not restrict the nationality or marital status of the commissioning party.
Parental Rights Protection: After the birth of a newborn, the commissioning parents can be directly registered as legal guardians, without the need for complicated adoption procedures.

Economic and Medical Advantages

Low-cost and cost-effective: the cost of a single cycle of surrogacy is about $50,000-$80,000, which is only 1/3 of the cost in Europe and the United States, and covers medical, legal and compensation for the surrogate mother.
International standard technology: using PGT-A (embryo chromosome screening) and Timelapse dynamic culture system, the success rate can reach 60%-70%, and the live birth rate of some organizations even reaches 72%.

Analysis of the whole process of surrogacy service

Pre-preparation and matching stage

Initial consultation and program development: the commissioning party is required to submit health reports, marriage certificates and other materials, and the agency develops a personalized program according to the needs (e.g., gender selection, twins).
Surrogate mother screening: Matching qualified candidates through BMI (18.5-24.9), reproductive function assessment (AMH>1.1 ng/mL) and mental health screening (SCL-90 scale).

Medical manipulation and pregnancy management

Ovulation induction and embryo culture: 8-12 eggs/cycle using antagonist regimen (Gonal-F 225 IU + Menopur 150 IU) with 70% blastocyst culture rate.
Embryo transfer: painless ultrasound-guided procedure in ≤10 minutes, pregnancy confirmed by ultrasound 6-8 weeks after transfer.
Pregnancy monitoring: surrogate mother stays in the monitoring apartment, daily monitoring of blood pressure (<130/85mmHg), fetal heart rate (120-160 beats/min), and customized high protein diet (120g/day) and iron supplementation.

Postnatal legalization and cross-border procedures for surrogacy services

Birth certificate and nationality determination: DNA identification is completed within 24 hours after the birth of the newborn, and the birth certificate is certified by The Hague (Apostille) to ensure international validity.
Settlement in the home country: the client needs to prepare notarized documents, and some countries (e.g. China) need to be certified by the consulate, which takes an average of 3-4 weeks.

Cost structure and transparency of surrogacy services in Kyrgyzstan

Core Cost Items of Surrogacy Services in Kyrgyzstan

Medical fees: fees cover ovulation induction, embryo culture, transfer and pregnancy monitoring.
Surrogate Mother Compensation: single birth fee, 20% increase in compensation for twin births, paid in stages (30% for contracting, 40% after delivery).
Legal and administrative costs: including contract notarization, cross-border document processing and insurance.

Hidden Costs and Risk Budget

Multi-cycle costs: if the first transplant fails, there is an additional cost for the second attempt.

Potential Risks and Challenges

Legal and Medical Risks

Ambiguous legal rules: Despite the legality of surrogacy, the lack of clear regulations on the disposal of embryos, multiple fetus reduction and other operations may lead to disputes.
Differences in medical quality: the equipment of some organizations does not meet international standards, and there is a risk of embryo culture failure or misdiagnosis.

Ethical and Social Pressure

Rights and interests of surrogate mothers: Although the law requires the provision of nutritional subsidies and psychological support, there may be problems of compensation deduction or privacy leakage in actual implementation.
Social discrimination: under the conservative cultural background, surrogate mothers may face public opinion pressure or even family relationship breakup.

Risk Avoidance and Agency Selection Guide

5 criteria for compliant agencies

Legal qualification: need to hold a license for assisted reproduction services, and partner hospitals have ISO 9001 certified laboratories.
Transparent Fees: Fees should cover medical, legal and surrogate mother compensation, with no hidden clauses.
Surrogate mother protection: the agency must provide 24-hour medical supervision, mental health support and reasonable compensation mechanism.
Successful Cases: At least 10 live births and a rating of 4.5 stars or higher from a third-party platform (e.g. Trustpilot) are required.
Legal Support: A team of specialized lawyers will ensure that the terms of the contract comply with the laws of Kyrgyzstan and the client’s country of residence.

Self-protection strategy for the client

Perfect legal documents: the contract should specify the ownership of the embryos, medical responsibilities, and contingency plans, avoiding verbal promises.
Cross-border legal consultation: the commissioning party needs to consult a lawyer in advance in the home country to confirm the nationality of the surrogate child and the settlement process.

The future outlook of surrogacy in Kyrgyzstan

With the deepening of international cooperation, Kyrgyzstan is gradually improving its healthcare regulatory system. in 2025, the country plans to introduce EU-standard embryo laboratories and strengthen legislation on the protection of surrogate mothers’ rights and interests. However, the industry still needs to address the following issues:

Refinement of the law: clarifying the operational norms such as multiple fetus reduction and the duration of embryo freezing.
Ethical balance: avoiding the controversy of “designer babies” caused by the misuse of technology, and strengthening the review of medical ethics.
Globalization of services: Improve multilingual support and culturally adapted services to attract more international customers.
