Surrogacy in Kyrgyzstan: A Comprehensive Guide

Kyrgyzstan, a hidden country in Central Asia, is becoming a focal point of the global surrogacy market with its open legal environment, cost-effective medical costs and standardized surrogacy process. For singles, the LGBTQ+ community, and infertile families, it not only offers a legally compliant path to fertility, but also attracts international attention with costs that are 50% lower than those in Europe and the United States (around $50,000-$80,000 for the whole process). In this article, we will analyze the core advantages, legal framework and potential risks of surrogacy in Kyrgyzstan, and provide a practical guide for those seeking surrogacy.

Surrogacy in Kyrgyzstan

I. Legal Framework: The Most Inclusive Surrogacy Policy in the World

    Kyrgyzstan has legalized commercial surrogacy since the 2008 Law on Human Reproductive Rights and Their Safeguards, and the 2008 Law on the Protection of Citizens’ Health, Article 57, further clarified that any citizen, regardless of marital status, may have a child through third-party assisted reproduction, and that the surrogacy contract must be certified by a state notary public.2 This legal breakthrough has made Kyrgyzstan one of the most inclusive countries in the world in terms of legal clarity and safeguards. This legal breakthrough makes Kyrgyzstan the only country in the world where legislation guarantees the reproductive rights of single men.
  2. Legal requirements for surrogate mothers
    Status restrictions: the surrogate mother must be a citizen of the country, aged 20-40, and have given birth to at least one healthy child;
    Health Screening: Tests for infectious diseases (HIV, syphilis), psychological evaluation and proof of no genetic history in three generations are required;
    Spousal consent: married surrogates require a written authorization signed by their spouse, and surrogate mothers are prohibited from also serving as egg donors.

II. the whole process of surrogacy: from signing the contract to carrying the baby back home

    Centralized living: after 32 weeks of pregnancy, surrogate mothers will be unified to stay in the Moon Center, equipped with customized meals and 24-hour nursing care by a nutritionist;
    Risk prevention and control: prohibit surrogate mothers from exposure to tobacco, alcohol, strenuous exercise, regular monitoring of blood pressure and blood sugar to prevent gestational hypertension.
  2. Psychological support system
    Prenatal intervention: Reduce the risk of separation anxiety through positive thinking meditation and cognitive behavioral therapy (CBT);
    Postnatal buffer: suggest the client to send photos of the child’s growth on a regular basis and establish a progressive emotional detachment mechanism.
  3. Economic security mechanism
    Surrogate mothers receive an average of 15% of the total cost (about RMB 70,000), and the agency is required to set up a “health tracking fund” to cover metabolic syndrome screening and bone density monitoring for 1 year after delivery.

  1. Concerns about the commodification of the body
    The profit margin of some agencies reaches 300%, and poor women may have to undergo surrogacy several times due to financial pressure, resulting in excessive uterine wear and tear. It is recommended to choose a compliant agency that promises “the number of surrogacy times in a single year ≤ 1”.
  2. Difficulties in recognizing nationality
    Babies need to return to their home countries to settle down with foreign birth certificates, and if the documents have not completed the Hague authentication or DNA testing is delayed, they may become “stateless”.
